A teoria da reserva do possível: um obstáculo na concretização de direitos fundamentais e políticas públicas (The theory of reserving financially possible: an obstacle in the realization of fundamental rights and public policy)

Resumo

Resumo: Os direitos fundamentais sociais nasceram como uma demanda social a fim de forçar o Estado a prestações materiais que garantissem o mínimo de dignidade. Concretizar as políticas públicas necessárias é um desafio, especialmente se o administrador público se utiliza de escusas para deixar de concretizar direitos básicos, como saúde e educação. A polêmica a cerca da escassez de recursos como limite à concretização dos direitos a prestações estatais não é recente. Importou-se até uma teoria que viesse a justificar a falta de recursos para a não concretização de políticas públicas. Busca-se, assim, discutir como essa teoria tem sido aplicada no Brasil.

Summary: The fundamental social rights were born as a social demand to force the state to supply materials that guarantee a minimum of dignity. Delivering the necessary public policies is a challenge, especially if the public administrator uses of excuses to leave to realize basic rights such as health and education. The controversy about the scarcity of resources and limit the realization of rights to state benefits is not new. He cared even a theory that would explain the lack of resources for non-implementation of public policies. The aim is thus to discuss how this theory has been applied in Brazil.
